Lawyers for the plaintiffs — a group of well-known writers that includes comedian Sarah Silverman and authors Jacqueline Woodson and Ta-Nehisi Coates — didn’t immediately respond to a request for comment Wednesday. Meta also didn’t immediately respond to a request for comment. “This ruling does not stand for the proposition that Meta’s use of copyrighted materials to train its language models is lawful,” Chhabri wrote.On Monday, from the same courthouse, U.S. District Judge William Alsup ruled that AI company Anthropic didn’t break the law by training its chatbot Claude on millions of copyrighted books, but the company must still go to trial for illicitly acquiring those books from pirate websites instead of buying them.Meta countered in court filings that U.S. copyright law “allows the unauthorized copying of a work to transform it into something new” and that the new, AI-generated expression that comes out of its chatbots is fundamentally different from the books it was trained on.Chhabri said in the ruling that while he had “no choice” but to grant Meta’s summary judgment tossing the case, “in the grand scheme of things, the consequences of this ruling are limited. This is not a class action, so the ruling only affects the rights of these 13 authors — not the countless others whose works Meta used to train its models.”

Cloudflare is making it easier for publishers and content creators of all sizes to prevent their content from being scraped for AI training by managing robots.txt on their behalf, and allowing targeted blocking of AI crawling on sites that serve ads. Cloudflare is giving all website owners two new tools to easily control whether AI bots are allowed to access their content for model training. First, customers can let Cloudflare create and manage a robots.txt file, creating the appropriate entries to let crawlers know not to access their site for AI training.But recently, a new generation of crawlers has appeared: bots that crawl sites to gather data for training AI models. While these crawlers operate in the same technical way as search crawlers, the relationship is no longer symbiotic. AI training crawlers use the data they ingest from content sites to answer questions for their own customers directly, within their own apps.And while AI Search and AI Assistant crawling related activity has exploded in popularity in the last 6 months, we still see their total traffic pale in comparison to AI training crawl activity, which has seen a 65% increase in traffic over the past 6 months.To do that, website owners make their sites accessible to search engine crawlers, which index the content and make it discoverable in search results. But with the rise of AI-powered crawlers, that same content is now being scraped not just for indexing, but also to train AI models, often without the creator’s explicit consent.
